Thomas More’s Utopia is an iridescent and enigmatic work which evades a consistent interpretation. Throughout the entire dialogue, many contradictory positions are argued for, and More’s play with telling names makes it difficult to determine which person’s position we should embrace. In order to evade these problems, the paper suggests reading More’s work as a philosophical dialogue with the reader, in which More invites us to evaluate the different positions contained in the work against our own back- ground. The article presents a critical survey of the philosophical discussion of the mind-body-problem since the collapse of Rylean behaviourism. The major theories (identity theories, supervenience, emergentist materialism, dualist interactionism and functionalism) are sketched and briefly evaluated with regard to their advantages and disadvantages. The conclusion is that no satisfactory theory about the relation between mental and neurophysiological states exists today, but considerable progress has been made regarding the contours of this cluster of problems. A catalogue of criteria which every future (...) theory concerning the mind-body problem must fulfill is given at the end. (shrink)

Stanley Milgram was the first who tried to apply the results of his experiment on National Socialism. Historical science has hardly picked up on this subject with the exception of the American historian Christopher Browning. Despite of some serious problems which have occured by transferring the Milgram-experiment onto National Socialism we are convinced that the possibilities Milgram has opened up for contemporary history have not been exhausted yet. In this connection we would like to plead for a stronger distinction of (...) types of perpetrators, taking into account the latest results in criminology. The Milgram-experiment refers methodically to local studies of massacres and genocides. Its application on the bureaucracy of destruction seems particularly promising to us. Also, there should be included the rescuers of jews into the research on perpetrators as a controlling body. (shrink)

Kant is often regarded as an extreme retributivist, but recently commentators emphasize the importance of deterrence in Kant's basic justification of punishment. Kant's combination of deterrence and retributive elements, however, must be distinguished from others that are less plausible. To interpret Kant as merely adding retributive side-constraints to a basic deterrence aim fails to capture fully the retributive strain in Kant's thought. The basic questions are: who should be punished, how much, in what manner, and why? Kant held that all (...) and only the legally guilty ought to be punished, the legally guilty being also morally guilty, except when the legal requirement was to do something "immoral in itself." This case aside, violations of law also transgress an ethical duty to obey the law. Criminal punishments should be designed to match victims' empirically discernable losses in degree and kind, except when this would be impossible or degrading; courts cannot measure the ultimate moral desert of criminals, which depends on their inner "will." "Punishment" is not a mere disincentive in a "price" system of social control; it has an inherent expressive function, conveying a public message of moral disapproval of the criminal conduct in question. Understanding this together with Kant's basic theory of justice may help to explain his acceptance of ius talionis and condemnation of making exceptions for pragmatic reasons. It also accounts for the retributive "tone" of Kant's remarks, despite his insistence that public courts deal only with "external actions," not overall moral worth and character assessment. Kant wird oft als Vertreter einer extremen Vergeltungstheorie gesehen. Auf der anderen Seite betonen verschiedene Autoren in der letzten Zeit die Abschreckung als grundlegendes Element in Kants Rechtfertigung der Strafe. Ihnen gegenüber muß Kants Verknüpfung von Vergeltung und Abschreckung von anderen ähnlichen Verknüpfungen unterschieden werden, die weniger plausibel sind. Kant so zu interpretieren, als füge er zum Hauptziel der Abschreckung nur einige nebensächliche Elemente der Vergeltung hinzu, verfehlt den Vergeltungsaspekt in Kants Straftheorie. Die grundlegenden Fragen sind: Wer soll bestraft werden, wie schwer, in welcher Weise und warum? Kant war der Ansicht, daß alle, aber auch nur diejenigen bestraft werden sollen, die sich vor dem juridischen Gesetz schuldig gemacht haben. Wer sich vor dem juridischen Gesetz schuldig gemacht hat, hat sich auch moralisch schuldig gemacht, es sei denn, das vom Recht Geforderte sei etwas "an sich selbst Unmoralisches". Sieht man von diesem letzteren Fall einmal ab, dann enthält jede Übertretung des juridischen Gesetzes immer auch eine Verletzung der ethischen Pflicht, dem juridischen Gesetz zu gehorchen. Strafe sollte darauf angelegt sein, den empirisch erkennbaren Verlusten des Opfers nach Art und Ausmaß zu entsprechen, außer, wenn dies unmöglich oder erniedrigend wäre; Gerichte können die tatsächliche moralische Schuld von Verbrechern, die von ihrem inneren "Willen" abhängt, nicht messen. "Strafe" ist kein bloßes Abschreckungsmittel in einem "Preis"-System sozialer Kontrolle. Statt dessen hat sie die ganz wesentliche und ausdrückliche Funktion, die moralische Mißbilligung des jeweiligen verbrecherischen Verhaltens öffentlich zum Ausdruck zu bringen. Diese Interpretation, zusammen mit Kants grundlegender Theorie der Gerechtigkeit, kann helfen zu verstehen, warum Kant das ius talionis akzeptiert hat und warum er Ausnahmen, die aus pragmatischen Gründen gemacht werden, mißbilligt. Sie erklärt auch den "Tonfall" in Kants Äußerungen, der mir seiner Vergeltungstheorie zusammenhängt, auch wenn Kant darauf beharrt, daß staatliche Gerichte sich immer nur mit "äußeren" Handlungen befassen, nicht mit dem moralischen Wert insgesamt oder mit einer Beurteilung des Charakters einer Person. Die nach den Konventionen der Alten Geschichte gemeinhin mit dem Beginn der Regierungszeit des Kaisers Diokletian (284 n. Chr.) einsetzende Epoche der Spätantike (die Papyrologen sprechen seit diesem Zeitpunkt dagegen zumeist von der „Byzantinischen Zeit“) zeitigte eine Fülle von administrativen und fiskalischen Reformen, die sich auch in Änderungen der Zeitrechnung in den Provinzen des Reiches niederschlugen. Am besten studieren lassen sich diese Auswirkungen in der Provinz Ägypten, wo mit den Papyri eine Fülle von datierten administrativen Aufzeichnungen sowie öffentlichen und privaten (...) Urkunden zur Verfügung steht. Hier manifestiert sich in diesen Phänomenen zugleich die zunehmende Angleichung Ägyptens an die administrativen und fiskalischen Strukturen in den anderen Provinzen des Reiches, wenn man so will die „Romanisierung“ Ägyptens, deren Ergebnis das Verschwinden zahlreicher Besonderheiten war, durch welche sich in der frühen und hohen Kaiserzeit die Verhältnisse in Ägypten von denen in den übrigen Teilen des Reiches signifikant unterschieden haben, wenngleich dieser Umstand es nach der Auffassung des Rez. keinesfalls rechtfertigt, der Provinz als solcher einen Sonderstatus im römischen Reichsverband zuzuschreiben, wie dies eine traditionelle Richtung der althistorischen Forschung lange Zeit getan hat und teilweise immer noch tut. Die weltweit besten Kenner der diversen chronologischen Systeme des byzantinischen Ägypten und der mit ihnen zusammenhängenden, z. T. äußerst verwickelten Probleme sind zweifellos Roger S. Bagnall und Klaas A. Worp (B&W), die bereits vor 27 Jahren mit den „Chronological systems of Byzantine Egypt“ (CSBE. Studia Amstelodamensia, VIII. Zutphen 1978) eine Summe der aus ihrer Editionstätigkeit erwachsenden intensiven Beschäftigung mit den chronologischen Problemen byzantinischer Urkunden aus Ägypten vorgelegt und nicht nur dem Editor solcher Dokumente im besonderen, sondern auch der historischen und papyrologischen Forschung im allgemeinen ein unentbehrliches Hilfsmittel an die Hand gegeben haben. Schon ein Jahr später folgten mit den aus ihrer Feder stammenden „Regnal Formulas in Byzantine Egypt“ (RFBE. Bulletin of the American Society of Papyrologists, Supplement 2. Missoula/Montana 1979) und 1987 mit den zusammen mit A. Cameron und S. Schwartz verfaßten „Consuls of the Later Roman Empire“ (CLRE) zwei weitere solcher unverzichtbaren Hilfsmittel, die den auf dem Gebiet der epigraphischen und papyrologischen Hinterlassenschaft der Spätantike tätigen Forschern die Arbeit beträchtlich erleichtern. In Anbetracht des in der seit dem Erscheinen von CSBE vestrichenen Zeit enorm angewachsenen Quellenmaterials, welches nicht nur vielfältige neue chronologische Probleme aufwarf, sondern auch bereits bekannte in neuem Licht erscheinen ließ – einen Prozeß, den B&W mit zahlreichen Artikeln zur Chronologie der Papyrusdokumente des byzantinischen Ägypten (siehe die Bibliographie in CSBE) gewissermaßen kommentierend begleitet haben – bedarf diese Neuauflage der CSBE sicherlich keiner Rechtfertigung. Auch wenn mit der Volltextdatenbank der „Duke Data Bank of Documentary Papyri“ (DDBDP) sowie mit dem „Heidelberger Gesamtverzeichnis der griechischen Papyrusurkunden Ägyptens“ (HGV) nunmehr – zum Zeitpunkt der Erstauflage der CSBE noch nicht existente – äußerst nützliche digitale Ressourcen zur Verfügung stehen, die die Sammlung und chronologische Auswertung der Dokumente bedeutend erleichtern (worauf B&W in der Einleitung zu CSBE zu recht hinweisen [viii]), so ist dies zweifellos immer noch eine mühe- und entsagungsvolle Kärrnerarbeit, für die den beiden Autoren nicht hoch genug gedankt werden kann. Hinzu kommt, daß sich diese Arbeit nicht nur auf die Sammlung der Dokumente und der ggfs. seit ihrer Edition erfolgten Berichtigungen beschränkt, sondern B&W in zahlreichen Fällen auch selbst Lesungen überprüft und berichtigt haben. Anhand des fiktiven Falles eines jungen Mannes, dessen Leben trotz der vermeintlichen Vorteile von verbesserten genetischen Anlagen nicht so gerät, wie es sich die Eltern vorgestellt haben, fragen wir nach dem Maßstab des Erfolgs von genetischen Interventionen am Menschen. Wir kommen zu dem Schluß, daß die bisherigen Erfahrungen, die wir an anderen, weniger komplizierten Organismen wie Algen schon gesammelt haben, darauf hindeuten, daß die Resultate von Genmanipulationen viel weniger vorhersagbar sind und damit die Risiken für die Menschen viel höher und (...) unüberschaubarer sein werden, als die Optimisten aus der Genforschung bisher anzunehmen scheinen. Außerdem stellen wir die Frage, ob diese Richtung der vermeintlichen Verbesserung des menschlichen Lebens wirklich geeignet ist, tatsächlich die Leben der einzelnen Menschen oder der Menschheit insgesamt besser zu machen, oder ob sie nicht vielmehr auf einem engen Begriff des Lebenserfolgs beruht, der von den eigentlich ethischen Fragen nach dem besseren Leben für die Menschen eher ablenkt. Wenn dies der Fall wäre, würde sich die Suche nach den entscheidenden Verbesserungen des menschlichen Lebens auf dem Wege der genetischen Intervention nicht nur aus technischen, sondern auch aus ethischen Gründen als bedenklich erweisen. Certains sont simplement inépuisables; ils ne peuvent pas être accomplis une fois pour toutes — soit, comme la beauté, qu'ils ne se satisfassent pas d'une réalisation particulière; soit, comme l'éducation libérale, que leur limite recule au fur et à mesure qu'on s'en rapproche. (...) D'énormes institutions culturelles et traditionnelles se créent alors pour traduire l'effort par lequel l'homme tend vers eux. Dans une société où manque le nécessaire — nourriture, logement, vêtement — l'acquisition et la distribution des produits alimentaires monopolisent tellement l'attention des dirigeants que les besoins culturels y inspirent rarement des programmes d'action à longue portée. This essay is a discussion of Eve-Marie Engels' view on Evolutionary Epistemology (EE). In the first part two of the main doctrines of EE are criticized: (1.) that validity of human knowledge is to be explained as the result of evolutionary adaptation; yet (2.), that human cognitive capacities had been adequate to our ancestors life conditions but fail in relevant situations of modern world. In the second part the concept of reality underlying EE's adaptational view is discussed and compared with (...) Jean Piaget's concept of reality. Finally, it is held that some of the questions recently raised by proponents of EE, far from being new, have been dealt with already in historical epistemology. (shrink)

Philosophers have usually highlighted how the weakness and paucity of historical evidence underdetermine the choice between rival historical explanations. Focusing underdetermination on the link between theory and evidence comes, I argue, with three assumptions: competing hypotheses are easy to generate, investigators agree on the constitution and interpretation of the evidence and a plurality of hypotheses is a useful evil to reach consensus. The last assumption implies that the sustained coexistence of incompatible hypotheses is considered as a scientific failure. I argue (...) that this negative vision of sustained disagreement has monistic undertones. By drawing from a case study in evolutionary biology, this paper defends a form of scientific pluralism. Firstly, I show that underdetermination is not only found at the inferential level but also at the level of the constitution and interpretation of the evidence, on the choice of investigative scaffolds and when interpreting background theories. Because of that, competing hypotheses exhibit a degree of methodological incommensurability. While catastrophic from a monistic standpoint, I defend that scientific pluralism gives a different, and I think richer, account of such situations. On the plus side, competing approaches benefit from their sustained coexistence and interaction. I argue that this generates direct and indirect epistemic goods independently of whether the controversy is solved. Scientific pluralism also shifts our attention from achieving consensus to managing disagreement. The challenge becomes to maintain the conditions for fruitful interactions in a community with incommensurable approaches and heterogeneous expertise. (shrink)

This paper is about the semantic analysis of referentially opaque verbs like seek and owe that give rise to nonspecific readings. It is argued that Montague's categorization (based on earlier work by Quine) of opaque verbs as properties of quantifiers runs into two serious difficulties: the first problem is that it does not work with opaque verbs like resemble that resist any lexical decomposition of the seek ap try to find kind; the second one is that it wrongly predicts de (...) dicto (i.e. narrow scope) readings due to quantified noun phrases in the object positions of such verbs. It is shown that both difficulties can be overcome by an analysis of opaque verbs as operating on properties. This is a strongly modified version of a paper entitled lsquoDo We Bear Attitudes towards Quantifiers?rsquo that I have presented at conferences in Gosen (Gesellschaft für Sprachwissenschaft), Ithaca (SALT I), and Konstanz (Lexikon). The aim of the article is to propose a way to determine to what extent a hypothesis H is confirmed if it has successfully passed a classical significance test. Bayesians have already raised many serious objections against significance testing, but in doing so they have always had to rely on epistemic probabilities and a further Bayesian analysis, which are rejected by classical statisticians. Therefore, I will suggest a purely frequentist evaluation procedure for significance tests that should also be accepted by (...) a classical statistician. This procedure likewise indicates some additional problems of significance tests. In some situations, such tests offer only a weak incremental support of a hypothesis, although an absolute confirmation is necessary, and they overestimate positive results for small effects, since the confirmation of H is often rather marginal in these cases. In specific cases, for example, in cases of ESP-hypotheses, such as precognition, this phenomenon leads too easily to a significant confirmation and can be regarded as a form of the probabilistic falsification fallacy. Between 1783–1795 Johann Gottfried Herder wrote a manuscript „Anfangsgründe der Religion“, which is being published here for the first time. The manuscript, which is not in Herder's handwriting, is part of his literary remains in Berlin. It is a preliminary text of Herder's „Catechetical Explanation“ to Luther's Catechism: „Luthers Katechismus. Es wird vorgeschlagen, die Implikationen von Kants "Menschheitsformel" als ein Bündel von mit einander verwandten Vorschriften zu interpretieren, die das moralische Nachdenken darüber, wie die Prinzipien unserer tagtäglichen Entscheidungen spezifiziert und interpretiert werden sollten, leiten und begrenzen können. Der Beitrag bearbeitet sodann die folgenden drei Fragestellungen: Was folgt aus dem Vorangehenden (...) im Hinblick auf die Behandlung von Straftätern bei der Verbüßung ihrer Strafe? Was empfiehlt die "Menschheitsformel" - einmal abgesehen von Kants "offizieller" Straftheorie - im Hinblick darauf, wer, wie stark, in welcher Weise und warum bestraft werden sollte? Gibt es Konflikte zwischen diesen Empfehlungen und Kants "offizieller" Straftheorie, die eine Revision seiner Gründe für diese Theorie erforderlich machen? Drawing from Kant's moral theory, this essay develops an account of what is required to treat persons with dignity, or as "ends in themselves". It proposes to regard the implications of Kant's humanity formula as a cluster of related precepts that can guide and constrain moral deliberation about how to specify and interpret the principles that should guide day to day decisions. The essay then addresses three questions: What is implied regarding how offenders should be treated while undergoing punishment? Apart from Kant's official theory of punishment, what would the humanity formula recommend regarding who should be punished, how much, in what way, and why? Are there conflicts between these recommendations and Kant's official theory of punishment that invite reexamination of his grounds for his official theory? (shrink)

The varied reception history of Victor Hugo's novel L'Homme qui rit (1869) is outlined in the context of exemplary historicisations of the "laughing face"-character. This reconstruction deals with the interplay of aesthetics and passion, on the one hand, and with the effects of intermedia encounters of literature, photography and film, on the other. Not only the traditional naturalisation of medieval penalty practices (by defacing) is investigated, but also the modern media history of celebrities.

Naturalism is the current orthodoxy in analytic philosophy. Naturalism is the conjunction of the (ontological) claim that all that truly exists are the entities countenanced by the natural sciences and the (epistemological) claim that the only true knowledge is natural-scientific knowledge. Drawing on some recent work in Critical Theory, this article argues that naturalism qualifies as an ideology. This is the case because naturalism meets three key aspects shared by paradigmatic cases of ideology: (i) naturalism has practical consequences and implications (...) of a specific kind, (ii) those endorsing naturalism fall prey to a dual deception: having false meta-level beliefs about naturalism as being without alternative, and (iii) naturalism has a tendency towards self-immunisation. The article ends by suggesting we pull naturalism out of our collective cognitive backgrounds onto the main stage of critical discourse, making it a proper topic for philosophical critique again. SummaryThis paper proposes a reading of Thomas Aquinas’ doctrine of predestination as fundamentally oriented towards and realized in friendship with God. On this reading, the seemingly disparate questions, “What does it mean to be predestined?” and “What does it mean to grow in friendship with God?” are not only mutually illuminating but ultimately coterminous. In the first part of the paper, I contextualize this theological rapprochement by foregrounding Aquinas’ treatment in the Summa Theologiae of predestination as a Christocentric, communal (...) reality, and by considering friendship with God as the end of Aquinas’ doctrine of grace. In the second part, I attend to Aquinas’ scriptural commentaries on Romans and the Gospel of John, in order to conduct a reading of predestination in/as friendship with God. Ultimately, as invited in friendship and adopted in grace into the life of Christ, God’s ordering of the rational creature to eternal life is nothing other than God’s ordering of humanity as viator to friendship with Himself in the inner life of Trinitarian love itself. John Rawls' conception of a reasonable pluralism proceeds on the epistemological assumption that it is not possible to set up one specific notion of justice attached to certain beliefs about the nature ofthe person, the purpose and the goal of human life. The liberal position insists on the principle of moral justification, according to which no norm is legitimate unless it can be accepted in principle by all affected persons. According to this view, it is recommended, in public debates where (...) the legitimacy of laws and state actions is being disputed, citizens should confine themselves to the use of religious arguments for which independent, secular reasons can be given. This conception has elicited an array of critical responses from authors of a religious persuasion. Critics point above all to the unequal terms of entry to public debates. But it can be shown in termsofamodest foundationalist epistemology that the required translation of religious beliefs in secular reasons is not an unfair and unjustified charge. Personally justified basic beliefs can be tested in intersubjective and public procedures of reasoning without requiring believers to sacrifice their religious or confessional identity. (shrink)

Is it however ethically acceptable or justifiable to interfere in this optimizing manner with the bodily integrity of an individual? This question leads the author to focus on a basic philosophical aspect: the identity of an existing (or future) human being who would like to undergo such (...) an intervention (or whose genome has been altered before birth). What is the normative significance of enhancement for existence throughout time, for the socially constituted personality as well as the self-conception of human beings? The author deals with these questions pertaining to personal autonomy and the good life. German description: aEnhancement bezeichnet biomedizinische Eingriffe, die auf die Verbesserung korperlicher Eigenschaften wie Ausdauer oder Attraktivitat, die Erweiterung kognitiver Fahigkeiten oder die Steigerung der Gemutsverfassung abzielen und von vielen Menschen in immer starkerem Ausmass nachgefragt werden. Doch ist es uberhaupt ethisch zulassig oder vertretbar, dass auf diesem Wege aoptimierend in die leibliche Integritat eines Individuums eingegriffen wird? In which sense can human beings be conceived as social animals? To elucidate this question, the present paper distinguishes the logical sociality of all living beings from the material sociality of social animals and the political sociality of self-conscious social animals. The self-conscious political sociality that characterises the human genus-being requires a complex interplay of first and second person through which alone we can participate in our form of life and determine its content. The human form of life thus constituted (...) is characterised by a particularly open, and at the same time precarious, membership which involves specific forms of vulnerability and power. Against this background, forms of objective spirit are necessary which grant us a generalized recognition and relieve us from the contingency of each particular second-personal recognition, without abandoning the openness of the sociality of the human form of life. This double requirement has led to paradoxical institutions in modern society which strive to protect and ensure the sociality of the human form of life precisely by naturalising and individualising our access to it. Die sich um 1800 neu konstituierende Disziplin der Biologie und die idealistische Naturphilosophie Schellings bemuhen sich in ihrer Frontstellung gegen einen unkritisch und ontologisch verstandenen Mechanismus um eine dem Leben angemessene Beschreibung und Erklarung der Lebensphanomene. Vor diesem Hintergrund wird im ersten Teil der vorliegenden Studie das Werk des Naturforschers Carl Friedrich Kielmeyer im Kontext der zeitgenossischen philosophischen und naturforschenden Diskussionen verortet, bevor im zweiten Teil die Bedeutung von Kielmeyers Phanomenologie des Organischen fur die systematische Ausarbeitung des Schelling'schen Systems der (...) Naturphilosophie aufgezeigt wird. In their animosity towards an uncritical and ontology-based mechanism, both the new discipline of biology, which was becoming established around 1800, and Schellings idealistic natural philosophy strove for a description and explanation of the phenomena of life which were pertinent to life. Against this backdrop, the work of the naturalist Carl Friedrich Kielmeyer is placed in the context of contemporary philosophical and naturalist discussions of the time in the first part of this study before the significance of Kielmeyers phenomenology of the organic for the systematic development of Schellings system of natural philosophy is shown in the second part. In The Metaphysics of Morals Kant suggests that the bad results of wrongful acts can always be imputed to the agent but the bad results of dutiful acts can never be. Although Kant's concern in the context was apparently legal imputation, the article considers how Kant's doctrine might apply to questions about moral responsibility for bad consequences in cases where legal enforcement is inappropriate. First , interpretative questions are addressed. For example, does imputation imply being to blame for bad results (...) or merely being liable to compensate for them? What are the criteria for bad results? What is the relation between assessments of responsibility for bad consequences and judgments of the moral worth or desert of the agent? Is the operative notion of "results" or "consequences" a descriptive or normative one? The suggestion is that liability, not blame, is what is crucial, and wrong-doers are responsible for whatever bad causally results from their misdeeds, whether it was foreseeable or not. Second , putative counter-examples to Kant's doctrine are evaluated: for example, cases where it seems an agent may be liable for bad consequences even when doing what is permissible, dutiful, or even meritorious. Although many of the objections fail to survive examination, there remain cases where bad results of a wrongful act cannot plausibly be imputed to the agent and other cases where the agent seems clearly liable for bad results despite having acted innocently. Such intuitive objections, however, must be reviewed from a larger perspective of a systematic moral theory. In der Metaphysik der Sitten nimmt Kant an, daß die schlechten Folgen einer pflichtwidrigen Handlung dem Handelnden stets zugerechnet werden können, im Gegensatz zu den schlechten Folgen pflichtgemäßer Handlungen, die dem Handelnden niemals zugerechnet werden können. Obwohl es Kant im Kontext der Metaphysik der Sitten offensichtlich auf die juridische Zurechnung ankommt, geht es im vorstehenden Beitrag um die Frage, ob sich Kants Lehre auf die moralische Verantwortlichkeit für schlechte Folgen in denjenigen Fällen übertragen läßt, in denen eine juridische Normdurchsetzung unpassend ist. Und zwar geht es erstens um eine angemessene Interpretation der einschlägigen Textstellen selbst. Etwa: Meint "Zurechnung", daß der Handelnde für die schlechten Folgen seiner Handlung zu tadeln ist, oder meint "Zurechnung" lediglich seine Haftung für den angerichteten Schaden? Was sind die Kriterien dafür, Folgen als "schlechte" Folgen zu bezeichnen? Welches Verhältnis besteht zwischen der Zurechnung von Verantwortlichkeit für schlechte Folgen und dem Urteil über den moralischen Wert oder das moralische Verdienst des Handelnden? Ist "Folge" als operativer Begriff deskriptiv oder normativ zu verstehen? Der Beitrag geht davon aus, daß Haftung, und nicht Tadel, das eigentlich Entscheidende ist und daß, wer pflichtwidrig handelt, für alles Schlechte verantwortlich ist, das von seinen Taten verursacht wird, und zwar gleichgültig, ob es vorhersehbar war oder nicht. Zweitens geht es um vermeintliche Gegenbeispiele zu Kants Theorie. Etwa: Es werden Fälle erörtert, bei denen es so zu sein scheint, daß der Handelnde auch für solche schlechten Folgen haftet, die aus einem erlaubten, einem pflichtgemäßen oder sogar aus einem verdienstlichen Handeln herrühren. Obwohl viele Einwände einer näheren Überprüfung nicht standhalten, gibt es doch Fälle, bei denen die Zurechnung der schlechten Folgen einer pflichtwidrigen Handlung immer noch als unplausibel, und andere Fälle, bei denen die Zurechnung der schlechten Folgen einer nicht pflichtwidrigen Handlung immer noch als notwendig erscheint. Value judgments are meaningless. This thesis was one of the notorious tenets of Carnap's mature logical empiricism. Less well known is the fact that in the Aufbau values were considered as philosophically respectable entities that could be constituted from value experiences. About 1930, however, values and value judgments were banished to the realm of meaningless metaphysics, and Carnap came to endorse a strict emotivism. The aim of this paper is to shed light on the question why Carnap abandoned his originally (...) positive attitude concerning values. It is argued that his non-cognitivist attitude was the symptom of a deep-rooted and never properly dissolved tension between conflicting inclinations towards Neokantianism and Lebensphilosophie. In America Carnap's non-cognitivism became a major obstacle for a closer collaboration between logical empiricists and American pragmatists. Carnap's persisting adherence to the dualism of practical life and theoretical science was the ultimate reason why he could not accept Morris's and Kaplan's pragmatist theses that cognitivism might well be compatible with a logical and empiricist scientific philosophy. Selected papers from the sections of the eighth international conference organized by the Society for Analytic Philosophy (GAP), Constance, Germany, September 17-20, 2012. The overall theme of the conference was "What may we believe? What ought we to do?", but the papers published here address a wide variety of questions from many fields of philosophy.

The paper delineates a modern conception of second nature that takes shape around 1800. Instead of just repeating, once again, the ancient topos that habit is a second nature, this modern conception makes use of a different paradigm for the understanding of cultural self-production, namely the work of art. According to this conception, the development of a second nature is not a question of mere habituation, but rather an essentially creative and expressive process whereby we take up nature and reorganize (...) it in such a way that it points beyond itself and becomes expressive beyond subjective mastery. The formation of culture and the production of a second nature is thus revealed as an aesthetic practice, a complex dialectical exercise, and a social practice of objectification. This conception of second nature which the paper traces back to Kant, Schiller, and Hegel not only allows us to grasp the relationship between spirit and nature more adequately than some of the neo-Aristotelian conceptions that dominate the current philosophical debate. It also opens up an instructive critical perspective on our contemporary aesthetic self-understanding. (shrink)

he idiom of human rights, like those of natural law and natural rights, picks out a special class of moral concerns that are among the most weighty of all as well as unrestricted and broadly sharable . It is more specific than the other two idioms by presenting all and only human beings as sources of moral concern and by being focused on threats that are in some sense official. The latter specification can be explicated as follows: By postulating a (...) right to X as a human right, we assert that every society ought to be so organized that all its members enjoy secure access to X . By not organizing itself in this way, a society expresses official disrespect for the human right in question - especially if insecure access to X is due to the threat of official violations, i.e. to persons' being denied X or deprived of X by those in positions of political authority. The members of such a society violate a negative duty of justice: the duty not to participate in the imposition of unjust social institutions, if they do not do what they reasonably can do toward initiating and supporting appropriate institutional reform.This understanding of human rights undercuts one important objection to the admissibility of social, economic, and cultural human rights, as these, too, can now be understood as entailing only a negative duty: not to impose upon one's compatriots a social order under which they lack secure access to basic necessities. Moreover, one can argue that even classic civil rights have social and economic aspects: To secure freedom from inhuman and degrading treatment, for instance, a society may need to do more than introduce and enforce appropriate criminal statutes. It may also need to establish adequate social and economic safeguards, ensuring perhaps that domestic servants are literate, know about their rights and options, and have some economic security in case of job loss. Die Rede von Menschenrechten - ebenso wie die von Naturrecht und von natürlichen Rechten - bezieht sich auf eine besondere Klasse von moralischen Anliegen, die zu den gewichtigsten gehören, uneingeschränkt gelten und allgemein akzeptierbar sein sollen. Dabei ist die Rede von Menschenrechten spezifischer als die Rede von Naturrecht und die von natürlichen Rechten, indem sie sich einerseits auf die moralischen Ansprüche von Menschen - aller Menschen - konzentriert und andererseits nur Bedrohungen ausschließt, die einen offiziellen Charakter haben. Das letztere Merkmal läßt sich wie folgt interpretieren: Wer ein Recht auf X als ein Menschenrecht behauptet, fordert, daß jede Gesellschaft so organisiert sein sollte, daß alle Mitglieder sicheren Zugang zu X haben . Wenn eine Gesellschaft sich nicht so organisiert, ist das eine offizielle Mißachtung der betreffenden Menschenrechte. Dies wiegt besonders schwer, wenn der Zugang zu X aufgrund offizieller Rechtsverletzungen unsicher ist, also von politischen Autoritäten verweigert wird. Mitglieder einer Gesellschaft, die in einer solchen Situation nicht nach Kräften auf die erforderlichen institutionellen Veränderungen hinarbeiten, verletzen eine negative Rechtspflicht: die Pflicht nämlich, nicht an der Durchsetzung ungerechter Institutionen mitzuwirken.Dieses Verständnis von Menschenrechten erleichtert die Begründung von sozialen, ökonomischen und kulturellen Menschenrechten. Auch diese Rechte können nämlich so verstanden werden, daß sie nur eine negative Pflicht implizieren, die Pflicht nämlich, Mitbürgern keine soziale Ordnung aufzuerlegen, unter der sie keinen sicheren Zugang zur Befriedigung ihrer Grundbedürfnisse haben. Darüber hinaus läßt sich plausibel machen, daß auch die klassischen Bürgerrechte soziale und ökonomische Implikationen haben. Um Freiheit von unmenschlicher oder erniedrigender Behandlung zu gewährleisten, wird eine Gesellschaft vielleicht mehr tun müssen, als lediglich geeignete Strafrechtsnormen durchzusetzen. Vielmehr werden häufig auch soziale und wirtschaftliche Vorkehrungen notwendig sein, die z.B. sicherstellen, daß Hausangestellte lesen und schreiben können, ihre Rechte und Möglichkeiten verstehen und im Falle plötzlicher Entlassung ökonomisch abgesichert sind. Le Grand's introduction to philosophy, written for use in Cambridge, was the first to be written along Cartesian lines. A section on moral philosophy, first included in the second edition 1672, drew on the common Aristotelian-style way of dealing with the subject-matter, but with modifications inspired by Descartes. In the third edition 1675 this section was almost doubled in size. The additional chapters are an unacknowledged paraphrase of the bulk of Pufendorf's De officio hominis et civis 1673. Le Grand's revision (...) can be taken as a point of transition from an older moral philosophy to modern moral philosophy. It is argued that the contrast between them is not one of virtues vs rules. Rather, the important difference is that the older is essentially eudaimonistic, both in its Aristotelian and Cartesian varieties, but the modern one is not. It relegates the quest for happiness to other disciplines such as psychology, and imports concepts which had belonged to moral theology, such as conscience, imputation, obligation, etc. into moral philosophy. Le Grands für den Gebrauch in Cambridge geschriebene "Einführung in die Philosophie" ist die erste, die nach kartesianischen Richtlinien verfaßt wird. Der Abschnitt über Moralphilosophie, der in die zweite Auflage von 1672 eingefügt wird, ist zwar immer noch in dem gebräuchlichen aristotelischen Stil geschrieben, enthält aber Modifikationen, die von Descartes inspiriert sind. In der dritten Auflage von 1675 wird der Umfang dieses Abschnitts nahezu verdoppelt. Die neu hinzugekommenen Kapitel sind eine Wiedergabe des Hauptteils von Pufendorfs "De officio hominis et civis" von 1673, die als Wiedergabe jedoch nicht kenntlich gemacht wird. Man kann Le Grands Bearbeitung als einen Schritt auf dem Weg von der alten zur modernen Moralphilosophie ansehen. Der Unterschied zwischen beiden ist nicht der Unterschied zwischen der Lehre von den moralischen Tugenden und der von den moralischen Gesetzen. Der entscheidende Unterschied ist vielmehr, daß die ältere Moralphilosophie, sowohl in ihrer aristotelischen, als auch in ihrer kartesianischen Variante, im wesentlichen eudämonistisch ist, während das auf die moderne Moralphilosophie gerade nicht zutrifft. Dadurch wird die Suche nach dem Glück an andere Disziplinen, beispielsweise die Psychologie, verwiesen, während die Moralphilosophie Konzepte wie "Gewissen", "Zurechnung", "Verbindlichkeit" übernimmt, die von der Moraltheologie entwickelt worden waren. The viewpoint of Evolutionary Epistemology (EE) and of Genetic Epistemology (GE) on classical epistemological questions is strikingly different: EE starts with Evolutionary Biology, the subject of which is population's dynamics. GE, however, starts with Developmental Psychology and thus focusses the development of individuals. By EE knowledge is seen as portraying or copying process, and truth is interpreted as a product of adaptation, whereas for GE knowledge is due to a construction process in which the production of true insights is only (...) one possibility among others: Like falsity, error and deception, true knowledge goes back to a free relationship to reality. The difference between scientific and common knowledge is hard to be checked by EE, since both result ultimately from human hereditary structures. The study of how scientific knowledge emerges from everyday cognition is rather the task of GE. (shrink)

Zusammenfassung Commentaries on Plato’s and Aristotle’s works were central to the Neoplatonic school’s curriculum. In a fixed order, established since Jamblichus, the Aristotelian writings were first read, then the Platonic ones. At the beginning, the logical writings of Aristotle and particularly his Categories were examined. But like any other work, the Categories were construed from the perspective of Neoplatonic anagogy. In addition, the commentator was obliged to work out the commonalities between the two philosophical teachings. That anagogical and harmonising approach (...) culminates in the commentaries on the Categories with the integration of the Aristotelian concept of substance into the Platonic concept of ideas. While Dexippus is primarily engaged in the right modes of predication corresponding to the sensible and the intelligible realm respectively, Simplicius focuses on the description of a continuous connection of being.
